1. Agreement to these terms

By creating an account or using Buffalo Contractors, you agree to these terms. If you do not agree, please do not use the service. If you are using the service on behalf of a business, you confirm that you are authorised to accept these terms for that business.

2. Who can use the service

You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information when you register and to keep it up to date. You are responsible for everything that happens under your account, so keep your password confidential.

3. What Buffalo Contractors does

Buffalo Contractors is a marketplace. We connect homeowners who post jobs with contractors who bid on them. We are not a party to the agreement you reach with the other user, and we do not perform, supervise, guarantee or insure any work.

Any contract for work is made directly between the homeowner and the contractor. You are responsible for satisfying yourself as to the suitability of the other party before you commit.

4. Homeowner responsibilities

• Describe your job accurately, including the scope and any access or site conditions that affect it.
• Only post work you are entitled to have carried out at the property.
• Respond to bids and messages in good faith.
• Agree payment terms directly with the contractor you hire.

5. Contractor responsibilities

• Provide accurate business information and the documentation we request for verification.
• Hold and maintain the licences, registrations and insurance required for the work you bid on in your jurisdiction.
• Submit bids you genuinely intend to honour.
• Carry out any work you are engaged to perform in a professional and workmanlike manner, and in compliance with applicable law.

6. Verification

We review contractor registrations, including tax identification and supporting documents, before enabling bidding. Verification is a reasonable check, not a guarantee. It does not amount to an endorsement, and it does not warrant a contractor's licensing, insurance, competence or the quality of their work. You remain responsible for your own due diligence.

7. Subscriptions and fees

Posting a job and receiving bids is free for homeowners. Contractors require a paid subscription for bidding access. Subscriptions are billed monthly in advance and renew automatically until cancelled.

You can cancel at any time and your access continues until the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change our fees on reasonable notice; changes apply from your next billing period.

8. Payments

Payments made through the platform are handled by a certified third-party payment provider and are subject to that provider's terms. You are responsible for any taxes arising from your use of the service or from work you carry out or commission.

9. Content you post

You keep ownership of the content you post, including job descriptions and photos. By posting it, you grant Buffalo Contractors a non-exclusive, worldwide licence to host, display and distribute that content for the purpose of operating and promoting the service.

You confirm that you have the rights to the content you post and that it does not infringe anyone else's rights.

10. Acceptable use

You agree not to:

• Post false, misleading, unlawful, offensive or infringing content.
• Impersonate another person or business, or misrepresent your credentials.
• Use the service to send spam, or to harass or defraud other users.
• Attempt to circumvent fees, interfere with the platform, or access it by automated means without our permission.

11. Suspension and termination

You may stop using the service and close your account at any time. We may suspend or terminate an account that breaches these terms, that we reasonably believe creates a risk to other users, or where we are required to do so by law. Where it is reasonable to do so, we will give notice.

12. Disclaimers

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error free, and we are not responsible for the conduct, work or solvency of any user.

13. Limitation of liability

To the fullest extent permitted by law, Buffalo Contractors is not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue or data, arising from your use of the service. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

14. Disputes between users

Disputes about work, payment or conduct are between the homeowner and the contractor. We are not obliged to mediate, but we may provide relevant account or message records where appropriate and lawful.

15. Changes to these terms

We may update these terms from time to time. If we make material changes we will update the date at the top of this page and, where appropriate, notify you. Continuing to use the service after changes take effect means you accept the updated terms.
